TRANSPARENCY REPORT
Trust is impossible without transparency, which is why Legist Online has begun publishing an annual “Transparency Report” that provides up-to-date information on government and other lawful requests for our users’ data.
As stated in Legist Online’s Privacy Policy, we may disclose or otherwise provide access to our users’ information upon request by a judicial authority, including a subpoena, court proceedings, search warrant, court order, and as required by applicable law, if we have a good faith belief that we are required to do so by law, with or without notice to you.
Legist Online receives requests for various categories of its users’ data from the U.S. and other governments, courts, and civil litigants. We strongly believe in the need to balance respecting our customers’ privacy rights with our legal obligations to disclose those customers.
In response to any government or other lawful request, Legist Online will review the lawfulness of the request. If we are required to comply with such a request and disclose user data, we will respond to the specific request as accurately as possible in accordance with applicable law (including the U.S. federal Stored Communications Act).
U.S. Legal Requirements:
We disclose account data only in accordance with our Terms of Service and applicable law, including the federal Stored Communications Act (SCA), 18 U.S.C., sections 2701-2712. Some of the requirements of U.S. law are set forth below.
A valid subpoena issued in connection with an official criminal investigation is required to compel the disclosure of basic subscriber information (as defined in 18 U.S.C. 2703(c)(2)), which may include first and last name, employment history, credit card information, email addresses, and IP addresses, and last login/logout addresses (if available).
A court order issued pursuant to 18 U.S.C. 2703(d) is required to compel the disclosure of certain records or other account-related information (other than message content), which may include message headers and IP addresses, in addition to the basic subscriber information listed above.
To compel the disclosure of any account's stored content, which may include messages, photos, videos, newsfeed posts, and location information, a search warrant issued under the U.S. Code of Criminal Procedure or similar state-mandated warrant procedures for reasonable cause is required.
International Law Enforcement Requirements:
We disclose account information only in accordance with our Terms of Service and applicable law. Law enforcement agencies are required to provide us with a certified translation in Ukrainian, English, and the legal basis for the request in accordance with local law.
Urgent Requests:
In situations of imminent harm, risk of death, or serious physical injury to any person, where immediate disclosure is required, a law enforcement officer may submit a request to help@legist.online. Note. We only review and respond to requests submitted by law enforcement officials. Individuals who become aware of an emergency should immediately contact local law enforcement directly.
Child Safety:
-
We report all apparent cases of child exploitation that come to our attention or are known to us from anywhere in the world to the National Center for Missing and Exploited Children (NCMEC), including materials that government agencies have brought to our attention in their requests. NCMEC works with the International Center for Missing and Exploited Children and law enforcement agencies around the world.
-
To increase transparency about the types of information that Legist Online can provide, we have compiled a classification of the types of requests we receive, as well as the legal procedures that must be followed before providing certain types of information. Before providing any data, we review each request for legality.
How to submit a request for data provision?
In accordance with our rules for storing/providing information about our users, as well as in accordance with our privacy policy, laws and requirements governing Legist Online, we store/produce such information solely on the basis of an official request (court order or official notification) from a law enforcement agency. In this regard, we kindly ask you to send us a formal request for any information that we are required to store/disclose. Such a request must contain a full and comprehensive description of the data that we are required to store/produce (including the specific URL), as well as the legal basis for submitting such a request.
The request can be sent by e-mail from the following e-mail addresses: help@legist.online (*we consider and respond only to requests sent by law enforcement officers).
